HIGH 5 to Happiness Program Agreement

INCLUSIONS:

The HIGH 5 To Happiness Program is a 12 week online course comprising of support and information on mindfulness, and activities to implement within your family in an online group environment (‘Group Program’).

The Group Program will consist of:

• Weekly activities broken down into 6 units including videos and worksheets provided as course material.
• A private Facebook group to interact with other parents on the Program.
• 3 monthly group calls with Your Coach via Zoom, occurring at specified times throughout the year (please note these do not always run alongside your start date).

Your participation in the Group Program runs from the start date for 12 full weeks, or until you have had the opportunity to join 3 coaching calls.

At the end of the 12 week Program you may remain in the Facebook Group to support other parents on their journey, and will have access to future Coaching Call Replays via the shared recordings.

GROUP COACHING CALLS:

Group Coaching Calls run every month at specified times throughout the year and may not run at the same time you start the Program, however you will be notified in the Facebook Group when these are going to start.

Each group call will be roughly 60 minutes in length and will take place online. Please note: all times and dates are a reference to Brisbane time (Australian Eastern Standard Time AEST). The calls will take place using the online platform Zoom, details of which will be posted into the Facebook Group ready for the call that month.

Your Coach would love for you to attend each call but understands that this is not always possible and ultimately it is up to you whether you chose to participate or not. Replacement calls are not available if you miss a session. A recording of the call will be posted in the Facebook Group to listen to the replay.

Calls are live so it is your responsibility to be on time to the calls; if you are late, the call will still finish at the set time. It is also your responsibility to ensure that you have working internet.

On the rare occurrence that Your Coach is unable to attend a call due to sickness, internet connectivity issues, technological difficulties or other circumstances outside of their control, you will be notified as soon as possible and a replacement call will be scheduled.

RELATIONSHIP:

You are entering into a coaching relationship with IPIK. By entering into this relationship you are making a commitment to yourself and to the Group Program to make your own decisions and drive your own results.

Your Coach is not a doctor, psychologist, psychiatrist or medical professional so cannot advise you on medications or any related subject. If this topic arises it is your responsibility to seek these services from a licensed professional.

COMMUNICATION:

IPIK welcomes communication in between group calls via the Facebook Group, therefore Facebook Messenger messages or other personal messages will not be responded to unless there is an emergency. If you have a personal issue you would like to discuss please email [email protected] and we will be in touch as soon as possible. Please post any other queries or questions directly into the Facebook Group.

It is our expectation that you will reach out if you hit a “sticky” spot that you would like some feedback on, and that you will share the successes that you have on the way to creating the family life you love! The Facbook Group is for you to utilise as much as you wish and is the best form of contact.

We will respond as soon as practicable to any of your questions and aim to actively communicate in the group, but please be aware that weekends are Your Coach’s days off so any posts on those days will be responded to as soon as possible the following week. There will of course be minimal exceptions due to illness, travel and holidays. Your Coach will communicate clearly with you regarding times that they will be unavailable.

CONFIDENTIALITY:

Over the course of the Group Program you are going to be given access to lots of great information and will also have the opportunity to build lifelong relationships with a group of amazing people! Confidentiality is very important to make the Group Program a comfortable place for all group members.

PAYMENT:

Payments can be made in full or on a weekly schedule but must be made by the agreed dates and no cancellations or refunds are available. If payments are not completed within the required date and/or in the instance that you have insufficient funds, an additional $30USD will be charged unless:

• (a) You send a request for extension to IPIK Project at [email protected]
• (b) Your Coach expressly agrees to the request.

If your credit card expires during the course of the payment plan, you will be required to supply new details to continue to make the payments. IPIK reserves the right to suspend your access to the Program if payments are more than 7 days after the specified due date.

REFUND POLICY:

The Group Program has limited spaces and requires your active participation so that Your Coach can get to know you and work with you and the other group members. For this reason, you are unable to pause or put on hold your membership to take part in a different rotation of the Group Program without the express written consent of IPIK.

If you are unable to take part in the Group Program, or do not use or interact with the content or communication via the Facebook Group, or do not attend the calls for any reason, you will be unable to obtain a full or partial refund of your payment.

Due to the nature of the delivery of the Program, if for any reason you decide not to continue with the Program, payment will be due in full within 14 days of this notice being given, regardless of how much access or participation you have received until then.

IPIK’s OBLIGATION TO YOU:

• You recognise that in the course of the Group Program you may divulge personal information, past history, goals, future plans, business affairs, relationship details, personal and other similar information (‘Personal Information’). Your Coach will not, at any time, either directly or indirectly, voluntarily use any Personal Information for their own benefit. Your Coach will not, unless required to do so by law, disclose any Personal Information to a third party.
• IPIK will provide all elements of The Program as detailed above, including but not limited to group coaching calls, Facebook Group interaction, access to unit information and any other relevant content.

YOUR OBLIGATION:

• Any information including photos and videos posted in the Facebook Group, weekly content, processes or tools provided by Your Coach, usernames or passwords, addresses or contact numbers seen by or provided to you, or any similar materials (‘Program Materials’) are confidential and must not be shared or given to people outside the Group Program without prior express consent from the author. If the author is Your Coach or IPIK, the prior express consent must be in writing.
• Program Materials may not be copied, modified, licensed, published, transmitted, distributed, uploaded, broadcast, sold or otherwise transferred or shared without IP-IK’s prior written express consent.
• You agree that you will not share any other member of the Group Program’s Personal Information or disclose that they are part of the Group Program without their consent.

TESTIMONIALS:

You agree that if you provide IPIK with a video testimonial, review, comment or feedback on the Group Program that this may be used for promotional purposes. If you do not wish for your testimonial, review, comment or feedback to be used for promotional purposes then please let IPIK know in writing.

GUARANTEES:

You recognise that IPIK and Your Coach are dedicated to your success and that with hard work and an open mind, you can create life-changing results. However, as with anything in life, there is no guarantee of results and your success will depend on your effort and choices made outside of the Group Program.

GOVERNING LAW:

This agreement is governed by the laws of Queensland, Australia. You are fully aware that you are able to seek legal advice regarding this agreement and agree that you have had the time and opportunity to do so. Any dispute will be settled within Queensland and if necessary, will use Queensland Courts.

TERMINATION:

This agreement will terminate after The Program end date as detailed in this document, however all terms under the Confidentiality and Payment headings survive termination of this agreement. This means that both You and Your Coach have the responsibility to honour confidentiality after the termination of the agreement.

If any part of this Contract is found to be invalid or unenforceable by a Court, the rest of the Contract remains fully operational and enforceable subject to the termination clause.
